TERMS AND CONDITIONS
RENTAL DATES AND TIMES
Unless otherwise specified, check-in is at 4:00 p.m. the date of arrival and check-out is no later than 11:00 a.m. the day of departure. Guest should advise Manager if they plan to arrive on a date other than what is specified in the reservation request. Failure to abide by check-out time will result in additional charges.
RESERVATION GUARANTEE
Reservations are guaranteed only after the reservation request has been submitted, reviewed by our staff for compliance, and payment is received. If Guest has not received an email guaranteeing the reservation, there is not a guaranteed reservation. Galveston Rental Home LLC is not liable for any expenses incurred or obligated by Guest that result from a canceled or rejected reservation request.
PAYMENT
Payment may be made via credit card, PayPal, or by check. Please make all checks payable to Galveston Rental Home LLC and mail to: 4038 Pirates Beach, Galveston, TX 77554. This address does not accept overnite delivery. Call 866 732 4968 x3 for overnite instructions.
CANCELLATION
In the event of a cancellation it is necessary to notify Manager as soon as possible. Cancellations made prior to 30 days in advance of arrival will receive a full refund of all monies paid less the application fee of $100. If cancellation is within 30 days of arrival, all monies shall be forfeited. However, every effort will be made to re-lease and if successful, a full refund of all monies paid less the application fee of $100 will be issued.
ITEMS INCLUDED
1. Bed linens, pillows and blankets for two queen beds and two twin beds. Linens are also available for a full sleeper sofa, a twin sleeper sofa, and/or portable crib, upon request.
2. One set of towels per person, which includes one bath towel and one face towel are provided. (Please note that towels used for going to the beach, fishing, boating, car washes, etc. are NOT provided and are the responsibility of Guest.)
3. Dish wares, pots, pans, utensils, glasses, coffee cups, measuring cups, small kitchen appliances, coffee filters, etc.
4. Most cleaning supplies such as garbage bags, dish soap, basic cleansers, etc.
5. Washer / Dryer
6. Patio furniture
7. Charcoal grill
SERVICES AVAILABLE
1. Basic utilities including electric, air conditioning, running water, hot water, and telephone Local and long distance telephone calls within the United States and Canada are included at no charge. No calls outside the country, collect or third party calls allowed. Any additional telephone charges will be billed plus a service fee of $20 per event.
2. Cable television is live in the living room. Please DO NOT attempt to order pay-per-view services. Any pay-per-view services ordered will be billed plus a service fee of $20 per event.
3. Parking up to six cars is allowed in the driveway and street combined. Please do not park on the grass.
4. Trash pick up is Monday. Two large trash bins are downstairs to collect garbage bags. Loose trash may not be placed in either the inside can or the outside bins. You MUST bag loose trash.
NOTE: AIR CONDITIONING AND APPLIANCES ARE NOT GUARANTEED. REPAIRS WILL BE MADE AS SOON AS POSSIBLE UPON NOTIFYING MANAGER. NO REFUND DUE TO FAILURE. NO REFUNDS DUE TO POWER BLACKOUTS, WATER SHORTAGE, FLOODING, CONSTRUCTION AT ADJACENT PROPERTIES, OR THE LIKE.
ITEMS AND SERVICES NOT INCLUDED
The following items and services are not included:
1. Any items that are personal belongings or property of the owner are not to be disturbed or removed from the house.
2. Housekeeping/maid or room service is not included during stay.
3. Personal toiletries (toothpaste, toothbrush, shampoo, deodorant, etc.)
4. Charcoal, lighter fluid, lighter
5. Beach towels (note: the house towels may not be taken to the beach)
6. Clothes detergent, fabric softener
PROPERTY CONDITION - CHECK-IN
Upon arrival, if anything at the property not as listed or described, Guest must notify the Manager immediately. Phone 866 732 4968 and press 9 for the repairs/emergency menu and further instructions. Under no circumstances should Guest remove any items whatsoever from the property. Any items missing will be charged at full replacement value.
CHECK-OUT PROCEDURES
1. Place all used towels and washcloths in the bathtub/shower. Please DO NOT make the beds.
2. Clean refrigerator. Leave no food or drink in it.
3. Sweep the floors. Broom and dustpan are in the hall closet.
4. Place all garbage bags into large green cans downstairs. No loose is allowed. Also, ensure yard is free from trash (cigarette butts, bottle caps, balloons, candy wrappers, etc.)
5. Flatten cardboard boxes and place beside green cans. DO NOT put cardboard boxes in green cans. Green cans are for trash in bags ONLY.
6. If staying over the weekend, you MUST wheel green cans to street Sunday. Green cans must face the street so the automatic trash truck can properly retrieve it. Trash pickup is Monday morning. Place cardboard boxes and oversized trash (if any) next to green cans on front lawn.
7. Close blinds and turn off all lights and ceiling fans, including covered porch.
8. Set thermostat to manual (not program) and 82 degrees (summer) or 65 degrees (winter).
9. Lock all doors (patio, upstairs, and downstairs), close and latch all windows.
10. Notify Manager of any needed repairs.
PROPERTY DAMAGE PROTECTION
All rentals require Property Damage Protection insurance, paid in advance, at time of rental. This policy covers accidental damage during the stay. To read more information about this insurance policy and what it covers, visit http://www.propertydamageprotection.com/hafaq.do
PROPERTY CONDITION - CHECK-OUT
Manager will inspect the house within 24 hours of vacating. All garbage must be bagged and taken to outside cans; yard must remain free of trash; refrigerator must be emptied; used linens and towels must be placed in bathtub; and floors must be swept. Failure to return property to such condition and/or tampering with locks, internet router, or other equipment on premises may result in additional charges.
UNACCEPTABLE BEHAVIOR
In the event of a house party, damages, guests exceeding the maximum allowed, pet not previously permitted, smoking in the house or patios, or grilling on porches/decks occur during this stay, Manager shall have the right to ask Guest to leave the premises immediately with no refund of monies paid. Guest agrees to maintain the property in the same condition in which it was found. Guest agrees to replace or pay for losses, breakage or damage should such occur. NEITHER MANAGER NOR OWNER SHALL BE RESPONSIBLE FOR DAMAGE OR LOSS OF GUEST PERSONAL PROPERTY.
MANDATORY HURRICANE EVACUATION
In the event of a mandatory/ordered evacuation by Manager, Owner, and/or Galveston County Emergency Management, Guest is entitled to a partial refund of the unused portion of the stay, including the date the mandatory evacuation order goes into effect. Should Guest choose to evacuate prior to the mandatory order, Guest will NOT be entitled to a refund of that portion of the stay. Please allow seven business days for any refunds related to mandatory evacuations.
AVAILABILITY
In the event that Manager or Owner is unable to make the property available, all monies will be refunded. Guest understand and represents that Guest will not hold Manager, Manager's employees, and/or Owners liable for any special or consequential damages which result from unavailability. Please allow seven business days for any refunds related to availability.
ASSIGNMENT
This agreement shall not be assigned or the premises sublet without prior written consent of Manager. That means that the person whose name appears in the reservation request is the person occupying the premises during the rental period. Guest will not give out the lockbox code, keys, or in any other way enable another party to occupy said premises, and further warrant that any such actions will constitute a breach of this agreement resulting in immediate eviction, forefiture of all monies paid, and/or further legal action. Guest hereby agrees to vacate premises no later than the time and date specified and return the keys immediately to the lockbox.
DISCRIMINATION
Galveston Rental Home LLC does not discriminate with respect to the rental of vacation homes based on race, color, religion, sex, familial status, national origin or disability. Galveston Rental Home LLC rents to responsible adults and does NOT allow large parties. Reservations and reservation requests made under false pretenses will be canceled and all monies retained.
MANAGEMENT AGENT
Oidhreacht Management LLC, a Texas Limited Liability Company d/b/a Galveston Rental Home LLC, is acting solely as management agent and is not the "Landlord" for purposes of Chapter 92 of the Texas Property Code. This rental agreement is at-will and on a day-to-day basis. Only one days' notice is required to vacate pursuant to Chapter 24 of the Texas Property Code. No notice to terminate Guest's tenancy is required pursuant to Chapter 91 of the Texas Property Code. To the fullest extent allowed by law, Guest waives any notice or other requirement that a "Landlord" is required to provide to a "Tenant" under Chapter 92 of the Texas Property Code. All notices by the Guest must be in writing and delivered via postal mail or facsimile.
ENTIRE AGREEMENT
These Rental Policies and the information provided by Guest on the Reservation Request constitute the entire agreement regarding the rental of the vacation home and, unless incorporated herein and therein, there are no other oral representations, warranties, agreements, or promises pertaining to the rental of the vacation home. All these matters shall be construed in accordance with the laws of the State of Texas, and exclusive venue with respect thereto is in the State Courts of Galveston County, Texas.
AMENDMENT
The terms and provisions of these Rental Policies may be revised and amended at any time, and from time to time, by Galveston Rental Home LLC, and if so revised and amended and furnished to the Guest prior to the Guest's occupancy of the vacation home, they shall for all purposes be considered effective and binding upon the Guest, as so revised and amended.
ACCEPTANCE
By submitting this form, Guest affirms that s/he has read and accepts all terms and conditions listed herein. Guest understand and further agrees that the Manager may, at their sole discretion, perform a verification and background check but will not perform a credit check.
